Purchase Terms
These Purchase Terms govern the sale of products by AURA Modern Home to you, the buyer. They apply to every order placed through auramodernhome.com.
By placing an order, you confirm that you have read, understood, and agreed to these Purchase Terms, including the Shipping Policy and Return Policy referenced below. These three documents together govern the transaction between you and AURA Modern Home.
If you do not agree to any provision of these Purchase Terms, do not complete your order.
1. Acceptance of Order
An order is not accepted until AURA Modern Home issues an order confirmation by email. The order confirmation is the binding acceptance of your offer to purchase.
AURA Modern Home reserves the right to refuse, modify, or cancel any order for any reason, including but not limited to:
- Suspected fraudulent activity
- Pricing or product description errors
- Inventory unavailability
- Inability to ship to the provided address
- Orders placed by suspected resellers or unauthorized dealers
- Orders that violate these Purchase Terms
If an order is canceled by AURA Modern Home after payment has been processed, a full refund will be issued to the original payment method.
2. Pricing and Errors
All prices are listed in U.S. dollars and are subject to change without notice. The price applicable to your order is the price displayed at the time the order is placed, subject to correction under this section.
Despite our efforts, pricing errors occur. If a product is listed at an incorrect price due to typographical error, system error, or supplier pricing inaccuracy, AURA Modern Home reserves the right to cancel the order or, at our discretion, contact you to confirm whether you wish to proceed at the corrected price. This right applies whether or not the order has been confirmed or charged.
Promotional codes, discounts, and offers may not be combined unless explicitly stated. Discounts are applied to the product price only and do not apply to shipping, taxes, or other fees.
3. Payment
Payment is processed at the time the order is placed. By submitting an order, you authorize AURA Modern Home to charge the payment method provided for the full order total, including product price, shipping fees, taxes, and any other applicable charges.
You represent that you are authorized to use the payment method submitted and that the billing information provided is accurate.
If payment cannot be completed for any reason, your order will not be processed.
4. Cancellations
Cancellation timelines are strict and are summarized here. Detailed conditions are in the Return Policy.
Standard orders
- Within 24 hours of purchase: full cancellation with no fee
- After 24 hours, before the order ships: a flat 10% administrative fee is deducted from the refund to cover credit card processing, freight booking, and order handling costs already incurred
- After the order has shipped: cancellation is not available. The order must be received and processed under the Return Policy.
Custom and made-to-order
- Within 48 hours of purchase: cancellation is available, but if materials or fabrics have already been ordered from suppliers, the refund will be issued less the cost of those materials and any processing fees incurred
- After 48 hours, or once production has begun: cancellation is not available, and no refund will be issued
A cancellation is effective only upon written confirmation from AURA Modern Home. Until you receive that confirmation, the order is considered active.
5. Returns
Returns are governed by the Return Policy, which is incorporated into these Purchase Terms by reference.
Key provisions include:
- 30-day return window from the date of delivery
- Returns require an active Return Authorization (RA) code
- Items must be returned in original packaging, unused, unassembled, and unaltered
- Customer is responsible for return shipping and full insurance
- Refunds to original payment are subject to restocking fees of 15 to 20% for standard items and 25% for oversized or special handling items
- Store credit and exchanges are available without restocking fees but remain subject to shipping responsibilities
- Original outbound shipping costs, including the actual freight cost of any order that shipped with free shipping, are deducted from the refund or credit
- Final sale, clearance, custom, and made-to-order items are not returnable
The Return Policy contains additional requirements and exclusions. You are responsible for reading it before placing your order.
6. Shipping and Delivery
Shipping is governed by the Shipping Policy, which is incorporated into these Purchase Terms by reference.
Key provisions include:
- Standard freight shipments are delivered curbside only
- Inside delivery, assembly, and packaging removal require White Glove service, which must be arranged and paid for separately before the order ships
- Damage in transit must be reported within 24 hours for freight shipments and within 3 business days for small parcel shipments
- Refused deliveries are treated as returns and subject to applicable fees
- AURA Modern Home does not guarantee delivery dates and is not liable for carrier delays
7. Title and Risk of Loss
Title to the products passes to you upon delivery to the address you provided. Risk of loss passes to you at the same time.
For freight shipments, delivery is considered complete when the carrier places the shipment at the curb or driveway of the delivery address. From that point forward, the products are your responsibility.
Damage occurring during carrier transit is governed by the damage reporting protocol in the Shipping Policy. Damage occurring after delivery is the responsibility of the buyer.
8. Fitment
The buyer is solely responsible for confirming that purchased products will fit through doorways, stairwells, elevators, hallways, and into the intended room.
Products that cannot be delivered, placed, or used due to fitment limitations are not considered defective and are not eligible for return on grounds of unfitness. If a fitment-related return is approved at AURA Modern Home's discretion, all standard return conditions and fees apply.
9. Product Information
AURA Modern Home makes reasonable efforts to display product colors, dimensions, materials, and finishes accurately. However:
- Colors and finishes may vary between monitors, devices, and lighting conditions
- Natural materials such as wood, leather, stone, and marble vary in grain, tone, veining, and surface character. Variation is expected and is not a defect.
- Dimensions are approximate and may vary slightly within manufacturing tolerances
- Product descriptions, specifications, and images may be updated without notice
These variations do not constitute grounds for return outside the standard Return Policy.
10. Damage Claims
Damage claims are governed by the Shipping Policy and are subject to strict reporting deadlines.
Damage not reported within the required window cannot be claimed against the carrier, and AURA Modern Home is not obligated to replace, refund, or credit the order in those cases.
Approved damage claims may be resolved through replacement, repair, partial credit, or refund, at AURA Modern Home's discretion.
11. Limited Warranty
AURA Modern Home warrants that products will be free from defects in materials and workmanship under normal residential use at the time of delivery.
This warranty does not cover:
- Damage caused by misuse, abuse, accident, or negligence
- Damage caused by improper assembly, installation, or maintenance
- Damage caused by exposure to direct sunlight, heat sources, humidity, or moisture
- Normal wear and tear, including but not limited to scratches, dents, fabric pilling, leather softening, wood patina, and finish aging
- Variations in natural materials
- Commercial, rental, or non-residential use
- Products sold as floor models, clearance, "as-is," or final sale
Warranty claims must be submitted with proof of purchase, photographs of the defect, and a description of the issue. Resolution is at AURA Modern Home's discretion and may include repair, replacement, partial credit, or refund.
This limited warranty is the sole warranty provided by AURA Modern Home. All other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose, are disclaimed to the fullest extent permitted by law.
12. Limitation of Liability
To the fullest extent permitted by applicable law, AURA Modern Home's total liability for any claim arising out of or related to a purchase is limited to the amount paid by the buyer for the specific product giving rise to the claim.
AURA Modern Home is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:
- Loss of use
- Loss of income or profits
- Loss of property
- Cost of substitute products
- Delays in delivery
- Damage to floors, walls, doorways, or other property during delivery or installation
This limitation applies regardless of the legal theory under which the claim is brought, including contract, tort, strict liability, or otherwise.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, AURA Modern Home's liability is limited to the maximum extent permitted by law.
13. Chargebacks
If a buyer initiates a chargeback or payment dispute through their bank or credit card issuer without first attempting to resolve the issue directly with AURA Modern Home, AURA Modern Home reserves the right to:
- Submit complete documentation to the card network in defense of the charge, including these Purchase Terms, the Shipping Policy, the Return Policy, order confirmation, delivery confirmation, and all communication records
- Suspend future orders from the buyer pending resolution
- Recover reasonable costs incurred in defending the dispute, including processor fees, to the extent permitted by applicable law
Filing a chargeback is not a substitute for the return and refund process described in the Return Policy.
14. Force Majeure
AURA Modern Home is not liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, weather events, pandemics, government actions, labor disputes, carrier disruptions, supplier failures, and disruptions to freight or shipping networks.
15. Governing Law
These Purchase Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Purchase Terms or any purchase from AURA Modern Home shall be brought exclusively in the state or federal courts located in Colorado, and the buyer consents to personal jurisdiction and venue in those courts.
16. Entire Agreement
These Purchase Terms, together with the Shipping Policy and Return Policy, constitute the entire agreement between AURA Modern Home and the buyer with respect to the purchase of products. They supersede all prior agreements, communications, and representations, whether written or oral.
If any provision of these Purchase Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
17. Changes
AURA Modern Home reserves the right to update these Purchase Terms at any time. Changes are effective upon posting to auramodernhome.com. The Purchase Terms in effect at the time of your order govern that specific transaction.
